This document contains the terms and conditions (Terms and Conditions) governing your use of this Website (www.10star.com.my), mobile application (iOS and Android), your purchase of any movie tickets, goods or services from 10 Star Cinemas Sdn Bhd, (Co. Reg. No. 1417467-H) (“10 Star Cinemas”) and participation in any contest organized by 10 Star Cinemas on the Website.
You must read, agree with and accept all of the Terms and Conditions contained herein and the Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference.
1. Application of These Terms & Conditions
1.1 You agree that your use of the remote sales channels, and the purchase of any movie ticket, goods or services (known as “10 Star Cinemas Services”) and participation in any contest organized by 10 Star Cinemas on the Website will be governed by the Terms and Conditions contained herewith including the Privacy Policy
1.2 If you do not agree to be bound by the Terms and Conditions, please do not use 10 Star Cinemas Services.
2. Registration (Website Only)
2.1. 10 Star Cinemas Services are available only to, and may only be used by individuals who can form legally binding contracts under the law. Without limiting the foregoing, our services are not available to children (persons under the age of 18). If you are under the age of 18, you can use 10 Star Cinemas Services only in conjunction with, and under the supervision of your parents or guardians.
2.2. You are solely responsible for your personal information save that 10 Star Cinemas will use and protect your personal information in accordance with 10 Star Cinemas Privacy Policy. Our current Privacy Policy is available at [Privacy Policy]. You acknowledge that no data transmission over the internet can be completely secure, and 10 Star Cinemas cannot give an absolute assurance that your personal information you provide to us will be secure at all times. If you object to your personal information being used in this way, please do not use 10 Star Cinemas services.
2.3. You acknowledge that if you do not register as a member of this Website, your activity in this Website will be limited. Employees of 10 Star Cinemas and its related bodies corporate are entitled to become members of the Website, but are not entitled to participate in any contests organised by 10 Star Cinemas on the Website.
2.4. Without limiting other remedies, 10 Star Cinemas may at its sole discretion limit your activity, temporarily or indefinitely suspend or terminate your membership and refuse to provide 10 Star Cinemas services to you if: (a) you breach any Terms and Conditions hereof or any terms incorporated by reference; (b) we are unable to verify or authenticate any information provided to us which we deemed is requisite and necessary; or (c) we believe that your actions may cause financial loss or legal liability to us.
2.5. 10 Star Cinemas may at its sole discretion change some or all of its services at any time. In the event 10 Star Cinemas introduces a new service, it shall be effective on the date expressly stated as the effective launch date of the service.
3. Terms Of Sale
3.1. ELIGIBLE PERSON
3.1.1. The following persons are allowed to transact on the remote sales channels
3.1.1.1 Any person who is above 18-years of age and owns a valid VISA or MASTERCARD Credit Card is allowed to transact on the remote sales channels.
3.2. MOVIE TICKETS
3.2.1. Movie tickets purchased via remote sales channels are strictly non-refundable and are not available for exchange under whatever circumstances except for technical error such as double paid. You may contact info@10star.com.my if you facing double paid issue.
3.2.2. 10Star Cinemas Sdn. Bhd. reserves the right to impose booking fees, service charges, taxes and/or surcharges for each successful transaction wherein the details thereof will be displayed prior to your confirmation of the said transaction. You may choose not to proceed with the said transaction without penalty any time before confirmation of the same. A booking fee of RM0.50 will be charged to your credit/debit card on every ticket purchased via our remote sales channel.
3.2.3. Seating for movie ticket purchased via the remote sales channels is available on a "best available" basis which is carried out by a prescribed computer program. Under some circumstances (where you will be notified) you may be allowed to choose your seating (subject to availability). By purchasing movie tickets via this Website and/or the remote sales channels you agree that:
3.2.3.1. save as otherwise allowed to choose your seat (subject to availability), you accept any seat allocated by the computer system in relation to each ticket purchased; and
3.2.3.2. 10 Star Cinemas makes no warranties or representations or undertakings to you that you will be seated at a particular seat, row or section of the relevant cinema.
3.2.3.3. All purchases are transacted in Ringgit Malaysia (RM).
3.2.4. Movie tickets purchased via the remote sales channels will be available for collection at the relevant cinema from either the ticket box (ticketing counter) or ticketing kiosk (where available) by producing the booking numbers.
3.2.5. Movie tickets are made available subject to the classification of the relevant film given by the Film Censorship Board of Malaysia. 10 Star Cinemas has a legal obligation to refuse admission to any person, who in the opinion of its Duty Manager, is under the minimum age required for 18SG, 18SX, 18PA and 18PL classified films (including children in arms). Proof of age may be required in certain instances.
3.3 OTHER GOODS AND SERVICES
3.3.1 All sales of food and beverages and E-Combo are subject to availability and 10Star retains the discretion to refuse your order.
3.3.2 For the redemption and collection of any food, beverage and/or E-Combo item, you are required to produce the valid proof of your purchase and/or redemption document (including a receipt of purchase, voucher, confirmation ID, physical ticket and/or e-ticket) issued or distributed directly by 10Star, its authorised distributors, partners or agents at the concession stand of the respective 10Star Cinema, failing which 10Star may refuse your redemption or collection.
3.3.3 All food, beverages and E-Combo items are only valid for redemption at the location of 10Star Cinemas and on the date specified in your booking confirmation. Any early or late redemption will not be entertained. Please read your online, email and/or mobile confirmation pages from 10Star Cinemas carefully for more information.
3.3.4 In the event any food, beverage and/or E-Combo item you have purchased is unavailable at the point of redemption, 10Star Cinemas has the discretion but not the duty or obligation to offer you the choice of a substitute product (up to the value of item(s) you had purchased) or to offer you a full refund.
3.3.5 Save and except for any error attributable to 10Star Cinemas and brought to the immediate attention of a 10Star Cinema concession representative at the point of collection, all food, beverages and E-Combo are strictly not exchangeable or refundable upon purchase. You are therefore required to inspect all purchased items at the point of your collection.
3.4. PAYMENTS
3.4.1. You represent and warrant that (a) any credit information you supply is true and complete; (b) charges incurred by you will be honoured by your credit card
or the financial institution; and (c) you will pay the charges incurred by you at the posted prices, including any applicable taxes.
4. Intellectual Property Rights
4.1. You acknowledge and agree that the copyright and other intellectual property rights in the remote sales channels and in all information and materials on this Website ("Website Content") are owned by 10 Star Cinemas, its affiliates, suppliers or licensors unless otherwise expressly indicated.The Website Content is protected by Malaysian and international copyright and trademark laws.
4.2. You agree that you will not do any of the following without 10 Star Cinemas’s written permission:
4.2.1. use 10 Star Cinemas’s trademarks, except for printing out a copy of this Website or as part of a reference to a 10 Star Cinemas product or service;
4.2.2. reproduce, copy, modify, merge, adapt, translate, re-publish, frame, upload to a third party, post, transmit, broadcast, communicate to the public or otherwise make the Website Content available to the public;
4.2.3. transmit or display the Website Content on any computer, system or network which permits electronic access by more than one user at a time;
4.2.4. use, sell, assign, rent, sub-licence or otherwise deal with the Website Content except as permitted by the Terms and Conditions; or
4.2.5. anything else which would infringe 10 Star Cinemas’s rights or the rights of 10 Star Cinemas’s content suppliers.

5.1. You agree that 10 Star Cinemas may at any time, a its sole discretion, modify:
5.1.1. The Display, look and feel of this website
5.1.2. The Website Content; or
5.1.3. the Terms and Conditions and the Privacy Policy, with such modifications shall automatically be effective from the time that they are initially posted on this Website or such date as specifically stated in our notification to be posted on the Website.
5.2. Your use of this Website and 10 Star Cinemas Services following any such change constitutes your agreement to follow and be bound by the Terms and Conditions as changed. For this reason, we strongly recommend that you review the Terms and Conditions whenever you use this Website and prior to your use of 10 Star Cinemas Services.

7.1. You agree that in using this Website, you will not:

8.2.5. That movie tickets to any particular cinema, movie or session will be available for sale to you; and
8.2.6. That content provided on this Website and 10 Star Cinemas Services are applicable or appropriate for use in locations outside of Malaysia.
9. Disclaimer
9.1. Except as provided by law, neither 10 Star Cinemas nor its affiliates nor the officers, directors, employees and agents of 10 Star Cinemas or its affiliates will be under any liability to you, in contract, tort or otherwise, in respect of any loss or damage (including consequential loss or damage, loss of profits, economic loss or loss of information) which may be suffered or incurred or which may arise directly or indirectly in respect of:
9.1.1. Your use of this Website and the remote sales channels;
9.1.2. The accuracy, completeness or usefulness of any Website Content or information contained in this Website and the remote sales channels;
9.1.3. Your use of any websites that this Website links to;
9.1.4. Any movie tickets or other goods or services supplied pursuant to the Terms and Conditons; or
9.1.5. Failure of 10 Star Cinemas to comply with its obligations under the Terms and Conditions.
9.2. If you are dissatisfied with this Website or any content on this site, or with the Terms and Conditions, your sole and exclusive remedy is to discontinue using 10 Star Cinemas Services. You acknowledge, by your use of 10 Star Cinemas Services, that your use is at your sole risk.
9.3. In the event any applicable law does not allow the limitation of liability set forth above or any part of this limitation on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of 10 Star Cinemas under such circumstances for liabilities that otherwise would have been limited and shall not exceed the price you paid for the purchase via the remote sales channels.
10. Indemnity
10.1. You agree to indemnify and hold 10 Star Cinemas and (as applicable) our parent companies, subsidiaries, affiliates, officers, directors, employees and agents harmless from any claim or demand (including reasonable solicitors’ fees) made by any third party due to or arising out of your breach of the Terms and Conditions or your violation of any law or the rights of any third parties or the use of the Website or remote sale channels.
11. Governing Law
11.1. These Terms and Conditions shall be construed in accordance with and shall be governed by the laws in force in Malaysia.
11.2. You inrevocably submit to and accept the exclusive jurisdiction of any of the Courts of Malaysia.
